1. General Information
These Terms and Conditions apply to all services provided by VIAVIA Records and VIAVIA EVENTS (hereafter “VIAVIA”), owned by Emiel van den Dungen, located at Jacob van Maerlantstraat 151, 5216JE, ‘s-Hertogenbosch.

2. Services
VIAVIA provides event organization, music production, and other related services. The specific services are outlined in individual agreements or invoices.

3. Payments

• Payments are due within 14 days of the invoice date unless otherwise agreed upon in writing.
• In case of late payment, VIAVIA reserves the right to charge statutory interest and any associated collection costs.

4. Cancellation and Refunds

• Cancellation by the client must be made in writing.
• If cancellation occurs less than 14 days before the event or service delivery, VIAVIA reserves the right to charge a cancellation fee up to 50% of the agreed price.
• Refunds, if applicable, will be processed within 14 days of agreement.

5. Liability

• VIAVIA is not liable for any damages resulting from the use of its services, except in cases of gross negligence or intent.
• The maximum liability of VIAVIA is limited to the amount paid for the service in question.

6. Force Majeure
In cases of force majeure (e.g., natural disasters, pandemics, strikes), VIAVIA reserves the right to cancel or reschedule the service without liability.

7. Intellectual Property
All intellectual property rights related to VIAVIA’s services (e.g., music recordings, branding) remain the property of VIAVIA unless otherwise agreed in writing.

8. Governing Law
These terms are governed by Dutch law. Any disputes will be resolved by the competent court in ‘s-Hertogenbosch, Netherlands.

9. Changes to Terms and Conditions
VIAVIA reserves the right to update these Terms and Conditions. The latest version will always be available on our website.
